    Like many other commercial web sites, the Insco web site utilizes a standard technology called a "Cookie" to collect information about how our site is used.  Insco reserves the right to store information on a user’s computer in the form of a "Cookie" or similar file to reflect the users’ preferences and to otherwise assist Insco in its business efforts.  This is a standard and traditional use of Cookies.

  7. ACCESS TO PASSWORD PROTECTED/SECURE AREAS:

    Access to and use of password protected and/or secured areas of this site is restricted to authorized users only.  Unauthorized individuals attempting to access these areas of the site may be subject to legal action.

  8. SUBMISSION OF INFORMATION:

    By submitting the information to any of our servers, or by linking to third party sites, you agree that (1) the material will not contain any item that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically, sexually or otherwise objectionable material of any kind including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law; (2) you will use reasonable efforts to scan and remove any viruses or other contaminating or destructive features before submitting any information; (3) you own the information or have the unlimited right to provide it to us and Insco may publish and/or incorporate it into any concepts described in it in our products without accountability or liability; and (4) you agree not to take any action against Insco in relation to information that you submit and you agree to indemnify Insco if any third party takes any action against Insco in relation to the material you submit.  Insco does not and cannot review the content posted by users on the site and is not responsible for any such content.  However, Insco may at any time at its sole discretion remove any content posted by users.

  9. DIGITAL SECURITY AND TECHNOLOGY:

    Protecting our users’ privacy is extremely important to Insco.  In order to access your account information, you will need a browser with a 128-bit encryption, which provides a very strong level of security.  Insco has designed the site to be as secure as reasonably possible given current internet and encryption technology.  However, by accessing this site and using the Insco system, you assume all associated risks and responsibilities.  Insco cannot and does not in any way guaranty that the information submitted to it can be confidential during the submission process or thereafter since hackers’ tools and capabilities are becoming more effective over time.

    Insco uses “secure browsers” which utilize Secure Sockets Layer ("SSL") technology to communicate with its servers.  This is a protocol designed by Netscape Communications Corporation to provide secure communications on the internet.  You can check to make sure you are in a secure site by the web address which will appear as "https://www."  The "s" at the end of "http" means that you have accessed a server using SSL.  Also, if you are using Netscape 4.0, Microsoft 3.0 or higher, you can check for the picture of a lock in the lower right hand corner of your browser’s application window.  If a lock is closed you are, in fact, in an area utilizing SSL technology.  For Netscape 3.0, look for a solid key in the same area.

    SSL was primarily designed to:

    1. Create a secure communication channel by encrypting all communications between you and the server.
    2. Authenticate that the server to which you have connected is the one it purports to be.
    3. Conduct a cryptographic word count to ensure data integrity between the server and you.  The word count is further encrypted so that it cannot be modified.

    Insco does not engage in the practice of selling or trading our customer information to third parties.  However, it may be necessary from time to time in order to provide better service to request such information as your name, address, e-mail address, telephone number, account number, etc.  We may use this information to respond to your requests, to contact you via e-mail to inform you of new services, or otherwise to better assist in the service of your accounts.

    Insco shall retain the right to not issue a password, in Insco’s sole discretion for any reason, if Insco determines that any of the information in the application has changed or is otherwise inaccurate.  Additionally, you are required to promptly inform Insco if a password should be deleted such as when an employee with knowledge of a password leaves your organization.  However, Insco cannot absolutely guarantee and does not guarantee that any information transmitted over the internet or accessed through this site is absolutely secure.  Thus, Insco specifically disclaims any liability for damages, whether based in contract, tort, strict liability or otherwise, including but not limited to any direct, indirect, incidental, consequential or special damages arising out of or in any way connected with access to or use of this site.

    In order to further protect your privacy, you should never reveal your password to anyone.  You should not write it down and place it where anyone can find it or figure out what it is.  You should be sure that you do not use common words that can be found in a dictionary or numbers in a series.  You should also never access this site from a computer to which anyone you do not trust has access.

    Internal access to customer data is limited to those who specifically need access to conduct their business responsibilities.  Insco uses security techniques designed to protect our customers’ information when used by employees and business partners to fulfill customer services. Except as described in our Privacy Policy, Insco releases information to third parties only with the customers’ consent or request, or when required to do so by law or other regulatory authority.  We may, however, utilize information concerning the principal and Obligee in collecting certain debts owed, or enforcing obligations to the company, or other actions brought against the company.  Further, when a court order or subpoena requires us to release information, we will attempt to notify you promptly to give you an opportunity to exercise your legal rights.  An exception to this policy is when we are prohibited by court order or law from notifying you, such as in cases where fraud and/or criminal activity is suspected.

    Insco may continually update its security programs as provided by the vendor in order to further protect our users’ privacy.  It is your responsibility, however, to make your clients aware that information pertaining to them may be accessed by you over the internet.  Again, while transmitting information over a Secure Socket Layer is generally regarded as a reliable and safe way to transmit the information, there is no absolute guarantee of privacy.  However, Insco will continue to evaluate its privacy systems to best serve you and your clients.

  10. SURVIVABILITY:

    If any provision in this terms and conditions of use is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.  This agreement and all actions contemplated by this agreement shall be governed by the laws of the United States of America, State of California, and any action brought to enforce the terms of this agreement shall be venued in the County of Orange, State of California, as if the agreement was a contract wholly entered into and wholly performed within the County of Orange, State of California.

  11. VIOLATION OF TERMS AND CONDITIONS OF USE:

    Insco reserves the right to seek any and all remedies available at law or in equity for violation of these terms and conditions of use, including but not limited to, the right to block access from a particular internet address to the site.

  12. CHANGES TO RULES AND REGULATIONS:

    Insco reserves the right to revise the terms and conditions of use at any time without prior notice and users are deemed to be apprised of and bound by any such changes.  Insco further reserves the right to modify or delete this site at any time, at Insco’s sole discretion.
